Forensic parameters DM 55/2014: how does the calculation of the tax rate work?
Decree of the Ministry, 10 March 2014, No. 55 "Regulation setting out the parameters for compensation for forensic professions" is the reference standard for judicial settlement of legal expenses in Italian civil cases. The regulation defines tables (Table A for civil cases) that associate each value range of the dispute with a minimum-maximum compensation range for each procedural phase.
The tool calculates the advisory fee by applying DM 55/2014 Table A parameters to ordinary civil procedure. By selecting the value bracket, you get the base compensation for phases, plus: CPA 4% (Attorney's Pension Fund), fixed fees 15% (Article 2 DM 55/2014) and VAT 22%.
Parameters shown are indicative and based on values [ASSUMED] derived from publicly available sources. Always verify official updated values against the Official Gazette and the Ministry of Justice website before using them in professional or judicial contexts. This tool does not constitute legal opinion.
Example of calculation (controversial value €10,000)
For a civil lawsuit of $10,000 (scale "From $5,201 to $26,000"), selection of all stages at the minimum level [ASSUMED]: study $540 + investigation $810 + decisional $1,350 = base compensation $2,700 → CPA 4% ($108) → forfeit expenses 15% ($405) → subtotal $3,213 → VAT 22% ($706.86) → total gross $3,919.86.
How is it used?
- Insert dispute value
Insert the dispute amount in euros or select "Indeterminate" for causes without a defined economic value. The determined value determines the DM 55/2014 Table A reference rate.
- Select Process Phases
Indicate the procedure stages undertaken by the attorney: study phase (case analysis), investigation (gathering evidence and hearing), decisional phase (discussion and verdict). The precautionary phase applies to urgent or appeal proceedings.
- Choose Liquidation Level
Choose between minimum, median (arithmetic mean of min and max), or maximum for each phase. The judge in liquidation can set compensation within the range of DM 55/2014, taking into account the complexity of the case and the activity performed.
- Interpret the result
The calculator shows the base compensation by phase, CPA (4%), fixed fees (15%), and VAT (22%) according to DM 55/2014 parameters. The gross total is indicative; the final package depends on the lawyer's evaluation, and in case of judicial liquidation, on the judge's discretion.
Frequently Asked Questions
How are forensic parameters calculated under DM 55/2014?
DM 55/2014 (Forensic Parameters) establishes reference tables for the settlement of lawyer fees in civil proceedings. The parameters are organized by value ranges of the dispute and procedural phases (preliminary, investigation, decisional, precautionary). Each table cell defines a min-max range: the judge determines the fee within this range based on the complexity of the case.
What does "value of controversy" mean in forensic parameters?
The value of the dispute is the amount in cash subject to the case (e.g., requested credit, damages compensation). If the case has no determinable economic value (e.g., personal status, non-possessory rights), the "Indeterminate" scale is used. DM 55/2014 provides 8 scales from "Up to €1,100" to "Over €520,000", plus the indeterminate case.
What is CPA and why is it added to the bill?
Contribution to Pension Fund (CPA) is a 4% contribution of the earned income paid to the National Forensic Court (CNF) pension fund. By law, it is charged to the client and subject to VAT. Also, fixed fees (15% of the compensation, as per art. 2 DM 55/2014) are also deducted before VAT, for a total gross amount including: compensation + CPA + fixed fees + 22% VAT.
Do the DM parameters of 55/2014 apply to all legal proceedings?
The DM 55/2014 applies mainly to civil proceedings before the judge and judicial settlement of compensation. Separate tables exist for criminal, administrative, and extrajudicial proceedings. Lawyers can freely agree on compensation with their client; the parameters of DM 55/2014 become binding only in judicial settlement (when the judge must quantify legal fees to be charged against the losing party).
Can the calculator be used for direct agreements between client and lawyer?
The parameters shown are indicative and based on the DM 55/2014 tables as a reference for judicial liquidation. Professional compensation is freely negotiable between lawyer and client; the values of the DM 55/2014 serve as market reference, not maximum. For specific agreements, direct contact with the professional is required: parameters can vary depending on the complexity of the case, the lawyer's experience, and any pre-agreed written agreements (Article 13 L. 247/2012).
Is the DM 55/2014 still in effect by 2026?
Yes, the DM 55/2014 is in effect. The regulation has been updated by DM 8 March 2018 n. 37 (which updated some brackets). Check with your lawyer or consult the Official Gazette to see if further updates have been issued since then. The values shown by this tool are indicative and based on publicly available data. Always refer to the official version of DM 55/2014 on the Ministry of Justice website or CNF for up-to-date parameters in force.
